Michael Jordan Testifies He Felt No Fear of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.
Team Investment and a Will to Win
The owner disclosed operational insights of his 23XI team, saying he put in $40 million of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated during testimony. “I was a new person, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination through a new lens.”
Central Issue: Charter Agreements and Contract Pressure
At issue is the expiration of a 2016 agreement where Nascar granted each team a franchise. The concept is similar to other major leagues with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan contended is breaking the law to keep two hands on the wheel.

Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the signature deadline didn’t sit well.
According to her, Joe Gibbs first attempted to call and talk Nascar out of forcing signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
